Terms of Service

Contractual terms governing access to Better QR, provided by We Are Monad®.

Last updated: 16 December 2025. Better QR is a product of We Are Monad® (company registered in England and Wales, number 09229110). These Terms of Service (the "Terms") form a legally binding agreement between We Are Monad® ("we", "us", or "our") and any person or entity using Better QR ("you" or the "Customer").

1. Acceptance

By accessing or using Better QR, creating an account, or clicking to accept these Terms, you confirm that you have read, understood, and agree to be bound by them. If you use Better QR on behalf of an organisation, you represent that you are authorised to bind that organisation, and "you" will refer to it. If you do not agree, do not use the services.

2. Our Services

Better QR provides tools to create, manage, and analyse QR codes and related digital assets (the "Services"). We may update, improve, or modify the Services at our discretion. Certain features may be labelled beta or preview; such features are provided "as is" and may be withdrawn at any time.

3. Eligibility and Accounts

You must be at least 18 years old and capable of forming a binding contract to use the Services. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your login credentials. You will promptly notify us of any unauthorised use or security breach.

4. Subscriptions, Billing, and Taxes

Access to certain features may require a paid subscription. Fees, billing cycles, and plan details are disclosed at the point of purchase. Subscriptions renew automatically at the end of each billing cycle unless cancelled in accordance with these Terms. You authorise us (and our payment processors) to charge all applicable fees using your selected payment method.

  • Changes and cancellations: You may upgrade, downgrade, or cancel at any time through your account. Changes take effect at the next billing cycle unless stated otherwise. We do not provide refunds for partial periods, unused Services, or downgrades unless required by law.
  • Trials and promotions: Trial access or promotional pricing is conditional on your compliance with these Terms and may be withdrawn if abused.
  • Taxes: Fees are exclusive of applicable taxes, duties, and withholdings unless expressly stated. You are responsible for paying all such amounts.

5. Acceptable Use

You will use the Services only for lawful purposes and in accordance with these Terms. You will not: (a) misuse the Services to transmit harmful code or disrupt networks; (b) attempt to gain unauthorised access to the Services or related systems; (c) use the Services to infringe, violate, or misappropriate any third-party rights; (d) reverse engineer, decompile, or otherwise derive source code except to the extent permitted by law; or (e) resell or provide the Services to third parties without our prior written consent.

6. Customer Content

You retain all rights to content you upload, generate, or distribute through the Services ("Customer Content"). You grant us a worldwide, non-exclusive, royalty-free licence to use, store, reproduce, display, and distribute Customer Content solely to provide and improve the Services and as otherwise permitted by law. You are responsible for the accuracy, quality, and legality of Customer Content.

7. Intellectual Property

We (and our licensors) retain all rights, title, and interest in and to the Services, including software, documentation, logos, and trademarks. No rights are granted to you other than as expressly stated in these Terms. You will not remove, alter, or obscure any proprietary notices on the Services.

8. Third-Party Services

The Services may depend on or interoperate with third-party platforms, including payment processors and hosting providers. Use of those third-party services may be subject to separate terms and policies. We are not responsible for third-party services and disclaim all liability arising from their use.

9. Availability and Support

We aim to keep the Services available and functioning but do not guarantee uninterrupted or error-free operation. Scheduled or unscheduled maintenance may occur. Support is provided as described in the applicable plan, subject to fair use and these Terms.

10. Confidentiality

Each party will protect the other party's confidential information with at least reasonable care and use it only for purposes related to these Terms. This obligation does not apply to information that is public, already known without restriction, independently developed, or lawfully disclosed by a third party.

11. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, or availability. We do not warrant that the Services will meet your requirements, operate without interruption, or be error free.

12. Limitation of Liability

Nothing in these Terms excludes or limits liability to the extent it cannot be excluded under applicable law (including liability for death or personal injury caused by negligence or for fraud). To the fullest extent permitted by law:

  • We are not liable for indirect, consequential, exemplary, incidental, or punitive damages, or for loss of profits, revenue, goodwill, or data, even if advised of the possibility of such damages.
  • Our total aggregate liability arising out of or relating to the Services or these Terms is limited to the amount paid by you to us for the Services in the twelve (12) months preceding the event giving rise to the claim.

13. Indemnity

You will indemnify, defend, and hold harmless We Are Monad® and its directors, officers, employees, and agents from and against any claim, loss, or expense (including reasonable legal fees) arising out of or related to your use of the Services, Customer Content, or breach of these Terms.

14. Termination and Suspension

We may suspend or terminate your access to the Services if you breach these Terms, if required by law, or if your use poses a security or operational risk. You may terminate at any time by cancelling your subscription. Upon termination, your right to use the Services ends, but sections that by their nature should survive (including payment obligations accrued, intellectual property, warranty disclaimers, limitations of liability, and indemnities) will remain in effect.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the Services or by reasonable means. Continued use after changes become effective constitutes acceptance of the updated Terms.

16. Governing Law and Disputes

These Terms and any dispute or claim (including non-contractual disputes) arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that we may seek injunctive or equitable relief in any jurisdiction to protect our rights.
